Overview Statement
The world has had many real health emergencies but governments never locked down their societies in order to address these health challenges. In contrast, the government has imposed one of the world’s longest-running lockdowns, if not the longest, when there is no real health emergency, as we shall see below.
In the process, by continually scaring and fooling the public that we have a health emergency, the government has imposed regulations that violate 38 provisions of the Constitution, especially human rights, as well as many protections of the Nuremberg Code.
Even if we had a real health emergency, Section 105 of the Local Government Code (LC) limits the wide-ranging control of national government to a cumulative total of 6 months. If they want to extend their control to more than 6 months, they will have to consult local government officials regarding any further extension of emergency measures.
Furthermore, Section 5 of the LGC (Rules of Interpretation) is clear. Should the national government and the LGU have different interpretations regarding current challenges, the interpretation of the LGU will prevail over that of the national government.
On top of all these, the government is injecting millions of Filipinos with experimental vaccines that have not been approved by regulatory agencies anywhere. These vaccines only have Emergency Use Authorization. No Health Emergency
The scientific evidence shows we do not have a health emergency. Therefore there is zero need to lockdown. Thus vaccines are not needed to lift the lockdowns. Ironically, they never will. Covid vaccines were designed to relieve only minor symptoms, not stop infections and lockdowns.

- The natural immune systems of 99.99% of Filipinos enabled them to survive the yearlong attacks of COVID-19 even before the mass vaccinations started.
- The Case Fatality Rate is low, has declined significantly for the last 9 months, and is currently hovering around 1.5% to 1.9%. We are at the tail end of the crisis.
- But even this low death figure is bloated due to fraudulent reporting. Many non-covid deaths were reported as COVID-19 deaths.
- There were financial incentives to report normal deaths as COVID-19 deaths. Remember the PhilHealth scandal?
- Despite these, there were no excess deaths from COVID-19 in 2020.
- There were 10,755 less total deaths in 2020 as compared with the average total deaths for the last five years (2015-2019).
- The total of all deaths in 2020 was 575,875. COVID-19 deaths only accounted for 8,209 (1.43%) or 19,758 (4.9%) of total deaths.
Clearly, we did not nor do we currently have an epidemic. Hence there is no need for a national health emergency.
Pneumonia is much more deadly than COVID-19, yet we never locked down when pneumonia kills tens of thousands of Filipinos. From 2015 to 2019, there were 56,830 deaths (9.7%) on the average from pneumonia out of a total of 586,630 deaths.
The country never locked down every time cases of pneumonia spiked up.
Many scientists consider COVID-19 deaths on the level of seasonal flu. Its Infection Fatality Rate (IFR) is quite lower than flu for most ages. For those above 70 years of age, the fatality rate is slightly higher than the flu. Yet, almost 95% of those in this age group survive if given proper care at the right time.
The manipulative media are highlighting the existence of more infectious variants of SARS-CoV-2. The virus has been mutating since last year. There are hundreds of variants. High numbers of cases published daily are fictitious.
- Dr. Kary Mullis, Nobel Prize winner and inventor of the PCR, continuously warned that the RT-PCR test should not be used for diagnostic purposes.
- These tests are inaccurate. Depending on the amplification numbers used (Ct), these RT-PCR tests can yield 95% false positives.
- The tests have been fraudulently used. Most of the time, a positive test result does not mean one is infected.
- And to be really infected does not mean one will die from COVID-19.

- For the vast majority of the time, there was no over-crowding of hospital facilities, the main excuse for the lockdown.
- Yet national government and mainstream media (MSM) persistently hyped the daily positive test numbers and framed these as infections. They lied to the public.
- Even assuming accurate counts, reported cases of high COVID-19 cases should not be the cause for alarm and fear.
- Severe cases account for only 0.66% of all active cases.
- Most cases come from younger groups who are the least vulnerable to COVID-19.
- A vast majority of Filipinos, usually more than 99%, recover from COVID-19.
Lockdowns do not work.
- Scientific studies have shown no difference between countries that locked down and those that did not. Instead, lockdowns inflict great harm on people and society.
- An increasing number of studies are giving a chilling picture of the psychological, economic, and societal damage of lockdowns.
- In the Philippines, lockdowns are destroying the economy, throwing millions into joblessness, forcing more millions into poverty, stunting the growth and development of untold millions of children, and spurring the rise of depression and suicides.

- It, together with some other countries, clearly demonstrates that lockdowns are not necessary.
Facemasks are ineffective and dangerous to one’s health.
- The virus is one thousand times smaller than the holes of the facemask. It can easily go in and out of the facemask. Masks do not stop the virus. - A statistical sampling of 10,000,000 million people from Denmark showed that the facemasks do not work.
- Instead, facemasks can worsen a person’s health. It can cause permanent neurological damage, among other health issues.
- CDC revealed that 86% of those who died from COVID-19 wore facemasks.
COVID-19 vaccines are super-dangerous and will not end infections and lockdowns
- Over half a million have already been injured. More than 10,000 have died. Thirty Eight (38) Provisions of the Constitution Violated
We are now in the middle of an illegal medical martial law. The continued headline coverage of daily COVID-19 cases, which we now understand to be highly misleading, has sown massive fear among the people. And in this state of fear, the government has installed draconian measures and robbed people of their basic rights and freedoms as guaranteed by our constitution. The lockdowns have violated 38 provisions of the 1987 Philippine Constitution.
The lockdowns desecrate the following provisions of the Constitution: Article II, Sections 4, 5, 6, 9, 10,11,12, 13, 15, 17, 18, 23, 24, 25 27, 28; Article III, Sections 1, 2, 3, 4, 5, 6, 7, 8, 15, 18; Article XI, Section 1; Article XII, Section 1; Article XIII, Sections 1, 2, 3, 11, 12, 14, 16, 18; Article XIV, Section 1; Article XV, Section 3. Here are a few examples.
School Closures Illegal
One of the most horrifying effects of the lockdowns is the closing of schools. With these millions of children pre-teens, teenagers, and young adults lost their rights to education. Not only have their rights been abused, but they were also subjected to physical, psychological, moral, and spiritual aberrations. These scars will accompany them throughout their degraded lives. The closing of schools is a crime against humanity.
Here are legal handles specific to education that can help in opening schools.
Article XIV, Section 1 of the Philippine Constitute provides:
“The State shall protect and promote the right of all citizens to quality education at all levels and shall take appropriate steps to make such education accessible to all.” [Emphasis added.]
Throughout the lockdowns, the government has done the total opposite.
How do you promote “quality” education when you force students to stay home and use digital schooling instead? Facebook is saturated with complaints regarding the impracticality of digital education.
How do you make education “accessible to all” when the government is fostering digital apartheid? They are dividing the students into two: those who have the means and the technology and those who do not have either.
Article XV, Section 3.2. of our Constitution stipulates:
“The right of children to assistance, including proper care and nutrition, and special protection from all forms of neglect, abuse, cruelty, exploitation, and other conditions prejudicial to their development;”
The closing of schools due to lockdown is a perfect means of fostering “neglect”, “abuse”, “cruelty” and “other conditions prejudicial to their development.
Children are neglected with their education is put on hold. They are abused when they are forced to wear masks and stay mostly indoors when the scientific evidence is clear that children are the least affected by COVID-19. It is cruelty when children are subjected to abuse and cruelty on a daily basis. It is cruel when children do not get the hugs and other gestures of care that are so important for their mental and emotional health. Stopping education also stunts the physical, emotional, intellectual, moral, and existential intelligence of the children. These are, therefore, prejudicial to their development as human beings.
The State cannot interfere with religious gatherings and worship
Article II, Section 6, states:
“The separation of Church and State shall be inviolable.”
In the Bill of Rights of the Constitution, Article III, Section 5,
“No law shall be made respecting an establishment of religion or prohibiting the free exercise thereof. The free exercise and enjoyment of religious profession and worship, without discrimination or preference, shall forever be allowed. No religious test shall be required for the exercise of civil or political rights.” [Emphasis added.]
Note the words, “No law shall be made”. So clearly the Bayanihan laws that have been enacted do not cancel this provision of the constitution. Forcing churches and other places of worship during lockdowns is a violation of this provision of the Constitution.
Facemasks and Social Distancing violate the Constitution
Article II, Section 11 of the Constitution states:
“The State values the dignity of every human person and guarantees full respect for human rights.”
There is no respect for human rights when one is forced to cower in fear for which the facemask is the symbol of submission to an outside illegal power. Furthermore facemasks do not work and are basically useless except when they “bless” you with illness. See entire section of Facemasks above for the scientific basis of these statements.
Article II, Section 15
“The State shall protect and promote the right to health of the people and instill health consciousness among them.” [Emphasis added.]
Facemasks do not promote health. It damages one’s health. False news or disinformation that comes with the lockdowns induces fear. Fear creates stress and weakens the immune system. Instead of promoting the tremendous health-protective value of the human immune system, the national government promotes unproven vaccines that are now killing tens of thousands and harming millions worldwide. (See details above.)
QR Codes and Contact Tracing are Illegal
The Constitution explicitly states in the Bill of Rights, Article III, as follows:
Section 2
“The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable …”
Section 3
The privacy of communication and correspondence shall be inviolable except upon lawful order of the court, or when public safety or order requires otherwise as prescribed by law.
These two sections clearly defend our Rights to Privacy. QR Codes used in contact tracing clearly violate these two sections of the Constitution. The moment you use these QR Codes, you are basically giving the app controller your 24/7 geo-location among others. It is really spooky to get the feeling that an unknown person is now stalking you 24/7. In addition, downloading these apps can make you vulnerable to other forms of data leaks coming from your smartphone.
Furthermore, Section 2 protects people from unjustified restraint. When you enter an establishment, say a supermarket or an airport, and they ask for your QR Code, in effect, they are restraining your right of participation and movement. They are practicing a form of “unreasonable searches and seizures”. You are no longer secure in your person when these forms of unjustified restraint are forced on you.

Our Country Needs Courageous Lawyers
Our nation has now been a victim of medical martial law. Since many government officials are ignoring the data and scientific evidence, the only way to stop this totalitarian imposition in our lives is to take legal action. Citizens of other countries have done this and stopped the damage and killings in their nation.
For me, one of the most surprising developments amidst the Covid challenge is the lack of lawyers stepping up to defend the massive abuse of human rights that is now going on in the country. The human rights violations are massive, yet resisting legal voices are nowhere to be found. The fear-mongering of the government and media has been effective and deadly.
We are thus calling any remaining courageous and conscientious lawyers to rise up and unite with suffering Filipinos to stop these totally illegal suppressions of the people’s human rights. If lawyers do not step up to the challenge, Filipinos will surely end up one day finding themselves inhabiting a totalitarian country where lies instead of truth prevail, where fear and cowardice have become the norm, and where slavery, not freedom, has become a way of life for the vast majority of Filipinos.
