New Zealand High Court Quashes Vaccine Mandate, Says Mandate Infringes Bill of Rights

The New Zealand High Court finds that the vaccine mandate introduced by the Minister for Workplace Relations and Safety is not “demonstrably justified in a free and democratic society”. Justice Cooke has ruled the mandate to be unlawful as it infringes on the “right to be free to refuse medical treatment…and it limits the right to manifest religious beliefs for those who decline to be vaccinated because the vaccine has been tested on cells derived from a human foetus which is contrary to their religious beliefs”.

Editor’s Note: There is no denying that mandating an experimental vaccine on citizens is unlawful. This fact has been upheld in several instances already [see US Federal Court: Biden’s Vaccine Mandate Unconstitutional, Belgian Court Rules COVID Vaccines Are Illegal, Court Demands Data from Austrian Health Ministry Justifying COVID-19 Rules].

We think that countries know that they were also imposing illegal rules, and were just waiting for citizens to raise their opposition. Now we must ask: what happens when courts find that leaders have implemented a policy that is illegal? Will they be held accountable for the damage caused by the policy they created?

We ask because after this ruling was released to the media, New Zealand Prime Minister Jacinda Ardern gave an interview to the media. She said, “that [removing the vaccine mandate] was something we were going to do regardless”1https://twitter.com/i/status/1498230403181645824 claiming that it was the high vaccination rate that has enabled the High Court to rule in favor of the petitioners, in an effort to undermine the importance of this court ruling. Take note, however, that the High Court has cited that unvaccinated people pose no greater danger to society than the vaccinated since both can be infected and can transmit the virus.
