Indian Bar Association Sues WHO for spreading disinformation about Ivermectin and causing the death of Indian citizens

It features the recent legal action undertaken by the Indian Bar Association (IBA) against Dr. Soumya Swaminathan, World Health Organization (WHO) chief scientist for India. Last June 13, 2021, the IBA sent the legal brief to Dr. Swaminathan, Dr. Tedros Adhanom Ghebreyesus, Director-General of the WHO, and Prof. Sunil Kumar, Directorate General of Health Services (DGHS). According to this document IBA accuses Swaminathan of causing the deaths of Indian citizens by misleading them about Ivermectin.

According to the legal brief, Swaminathan’s now-deleted tweet has led the State of Tamil Nadu to withdraw Ivermectin from their protocol, a day after the Tamil Nadu government indicated the same as treatment for COVID-19 patients. IBA further accused Swaminathan of using her position as a health authority to further the agenda of special interests to maintain the Emergency Use Authority (EUA) of vaccines.

IBA lead attorney Dipali Ojha threatened criminal prosecution against Swaminathan “for each death” caused by her act of commission and omission.

The legal brief cited the studies conducted by the Front Line COVID-19 Critical Care Alliance (FLCCC) and the British Ivermectin Recommendation Development (BIRD) as evidence for the effectiveness of Ivermectin. They also cited the court cases won by US Attorney Ralph Lorigo where hospitals were given court orders to administer Ivermectin to dying patients.

In a statement to the media, Ojha says that under section 302 of the Indian Penal Code, Swaminathan’s actions constitute murder by obstruction of treatment and are punishable with the death penalty or life imprisonment. Ojha notes “After receiving the said notice, Dr. Soumya Swaminathan went on the back foot and deleted her tweet. This has proved the hollowness of the WHO’s recommendation against Ivermectin for COVID-19. The dishonesty of  WHO and the act of Dr. Soumya Swaminathan in deleting her contentious tweet was witnessed by citizens across the world, as the news got wide coverage on social media. By deleting the tweet, Dr. Soumya Swaminathan has proved her mala fide intentions.”

Editor’s Note: If Dr. Swaminathan truly believed in the truth of her tweet, she would have stood by it, despite the backlash she is experiencing. She would, after all, have time in court to prove her innocence.

As evidence for Ivermectin starts to pour in, we want to see how the WHO will begin to explain why they obstructed the use of the drug for treatment and caused the unnecessary deaths of millions of people around the world. This lawsuit against a WHO chief scientist is a landmark case because it will send a powerful signal that disinformation is a serious offense.
